This Directive sets out the mechanism by which a Taxable Person must convert the value of a digital currency into UAE Dirham for the purposes of disclosure in the Tax Return. It applies both to supplies of digital currency and to supplies of Goods or Services for which the Consideration is received in the form of a digital currency. The Taxable Person must select three exchange platforms from the list of centralised public digital currency exchange platforms published by the Authority, use the same three platforms for all transactions during the same calendar year, and convert using the numerical average of their exchange rates prevailing at the date and time of the supply or of receipt of the Consideration. Records proving the exchange rates obtained from each of the three platforms must be retained in addition to the other record keeping obligations related to the supply. The Directive annexes the approved list of platforms and provides that the Authority will issue a public clarification on the procedures to follow where a rate is not available on three listed platforms.
