Article 40 of Decree-Law No. 157 of 2024 establishes the legal basis for granting judicial police authority to specific Tax Department employees. Article 40 - Judicial Police Authority
The Tax Department employees shall have the status of judicial police officers based upon a decision by the Minister. Hence, they will be entitled to access places, in which taxpayers practice their activities or keep their records and documents, to perform review and audit and find the tax violations. For this purpose, they may seek assistance from police officers.
